FACEBOOK & INSTAGRAM COMPETITIONS

Where Facebook giveaways occur whether it be in voucher form or products on our Wizard – Home, Garden, Camping Facebook and Instagram Pages, winners of these giveaways will be selected at random using an auto generated selection program.

Wizard vouchers are to be used online only and cannot be redeemed for cash, in a Red Dot store or replaced if lost or stolen.

Gift vouchers cannot be returned or exchanged (whether in whole or in part) for cash. The value stated on the voucher is expressed inclusive of GST.

Any purchases which exceed the value of the gift voucher will require the holder to pay the difference in price using another form of tender. No change will be given and any remaining balance will remain on the gift voucher to be used in whole or in part against future purchases.

Entrants must reside in Australia to be eligible as a winner for the competition.

Winners have 5 days from date of first contact to claim their voucher; otherwise their winnings will be forfeited.

 

THIS WARRANTY

1.1       In this Warranty references to:

(a)        “We”, “Us” and “Our” is a reference to F.M.A.Z Pty Ltd trading as Wizard Tools;

(b)        “You” and the “Consumer” means the purchaser of our Products for consumer or non-commercial purposes; and,

(c)        “Product(s)” and “goods” are to range of products, tools and equipment supplied by Us either directly via our website wizardtools.com.au or via our authorised retailers.

(d)        “Warranty” includes “Extended Warranty” however not that additional specific provisions apply to the Extended Warranty the primary difference being the Warranty period.

1.2       A complete list of Wizard Authorised Retailers is available upon request or by following this link.  This is important because this Warranty is voluntarily provided by Us in addition to Your rights under Consumer Law (see paragraph 2 below) and is not valid for second hand Products or for any Products purchased via non-authorised websites.

1.3       This Warranty covers the Product supplied against faulty materials or workmanship;  and, covers the replacement of parts, the repair labour used, a credit or refund of the price of the product or other compensation for the remainder of the Warranty period.  This Warranty and any Extended Warranty will be subject to Limitations and Exclusions.

1.4       The standard Warranty and any Extended Warranty provided is exclusive to You as purchaser and  is not transferrable to another person.

1.5       Unless expressly provided otherwise such as in the Schedule with additional warranty information, each  Warranty is valid for six (6) months from the date of purchase by You.  We may offer, establish or amend an extended Warranty for some Products from time to time.

1.6       In the Schedule of Products We provide specific warranties for types of Products and we make available Extended Warranty options and an option to obtain a discount coupon (“Coupon”). In order to obtain the Extended Warranty and discount Coupon You must register with Us.

1.7       Registration

(a)        To register please create a customer account via the instructions on our website.  Once you have created Your account we will send a confirmatory email to You requesting you validate Your email address.

(b)        Once your email address is validated you can register your Product with proof of purchase.    Please note that for the benefit of the Extended Warranty period You must register within 30 days of purchase of the Product.

(c)        Your initial registration will entitle you to the Coupon for the purchase of certain Products through the Wizard website.  Products must be purchased via Our websiste.  The value of the Coupon and eligible Productions are listed in the table in the Schedule.  When You enter Your Coupon code the cash value of the Coupon will be deducted from the Product Purchase price.

1.8       Other Coupon matters

(a)        Each Coupon can only be redeemed once so We encourage You to spend the full amount as a balance will not be retained.

(b)        The Coupon cannot be applied to delivery or shipping costs on Products purchased.

(c)        The Coupon will have the expiry date listed in the Schedule.  The standard Coupon life will be 4 months from the date of issue but some Coupons for certain Product offerings may have a different validity period.

(d)        The Coupons are provided on a voluntary basis by Us and We reserve the right to cancel any issued Coupon prior to its use in a purchase transaction without compensation.

(e)        We may offer Coupons as part of a marketing or promotional campaign from time to time and these general Coupon provisions shall apply unless the particular campaign materials provide otherwise.

  1. CONSUMER LAW GUARANTEES IN AUSTRALIA AND NEW ZEALAND

2.1       Our Products and goods come with guarantees that cannot be excluded under Consumer Law in Australia and New Zealand.  The consumer is entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage.  The consumer is also entitled to have the product repaired or replaced if the product fails to be of acceptable quality and the failure does not amount to a major failure.

2.2       Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

(a)        to cancel your service contract with us; and

(b)        to a refund for the unused portion, or to compensation for its reduced value.

2.3       You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

  1. UNDER THIS WARRANTY

3.1       Product presented for repair may be replaced by refurbished products of the same type rather than being repaired.  Refurbished parts may be used to repair the Product.

3.2       The Product covered by this warranty will be repaired, during normal business hours, at Our premises or at an authorised service centre without cost to You for parts and repair labour.

3.3       You are responsible for freight costs and insurance costs if the Product must be returned for repair / inspection to Us or to Our authorised service centre unless the cost of returning, removing or transporting the Product is significant in which case you should contact our customer service to discuss Your warranty claim.

  1. EXCLUSION OF IMPLIED WARRANTIES

To the full extent permitted by law, all warranties, conditions and other terms express or implied by statute, custom or common law are excluded.  Nothing contained in these terms and conditions excludes or restricts any consumer guarantee, warranty, condition, right or remedy implied by any statute (including the Australian Competition and Consumer Act 2010 and the New Zealand Consumer Guarantees Act 1993) which cannot be excluded, provided that, to the extent that the statute permits.  We are entitled to limit Our liability as set out in paragraph 3 above for a breach of a guarantee, condition or a warranty implied by that statute.

  1. HAZARDOUS MATERIAL

5.1       You are responsible for the care and cleaning of their Product prior to sending it to our designated inspection/service centre.  Any Product being sent to us must be cleaned.

5.2       It is an Occupational/Work Health and Safety risk for Our staff to inspect, repair or service a Product that has come into contact with a hazardous substance.  If We are asked to inspect, repair or service a Product that has in Our estimation come into contact with a hazardous substance including without limitation asbestos or silica dust We may not be able to inspect, service or repair the Product.  If this is the case, we will inform You and return the Product to You or make it available for collection.

5.3       We reserve the right to refuse to inspect, repair or service a Product which in Our estimation has been exposed to a hazardous substance.

  1. EXCLUSIONS AND LIMITATIONS

6.1       This Warranty will not apply if:

(a)        the Product fault, failure or damage is caused as a direct result of any repairs to the product which are made or attempted by a service provider other than by Us or by our designated authorised service centre;

(b)        the Product has not been used, operated or maintained in accordance with the manufacturer’s instructions (if any) as provided with the Product;

(c)       You use the Product in an abnormal manner; for example, if the Product is abused, misused, dropped, crushed, impacted with any hard surface, exposed to extreme heat (including fire) or cold, exposed to the elements including inclement weather, not maintained properly, or used after partial failure;

(d)        damage to the Product is caused by sand, water damage, corrosion (including salt damage), fire, vermin and/or insect infestation, power outages or surges, or inadequate or improper voltage or current or  inclement weather or act of God;

(f)        the Product has been modified, incorrectly adjusted or operated, subjected to incorrect electrical supply or inconsistent electrical supply, or used with inappropriate accessories;

(g)        the Product is tampered with in any way, or if the damage has been caused by an extraordinary event or circumstance beyond Our reasonable control;  or

(h)        the Product’s serial number (or identification number), as applied by the manufacturer, has been altered or removed from the Product.

6.2       This Warranty does not cover normal wear and tear of the Product or its parts.  Parts which may include but are not limited to carbon brushes, bearings, seals and O-rings should be regularly inspected so that the wear and tear on such parts does not lead to failure of the Product.  For optimum performance the Product should be inspected and maintained regularly by our designated authorised service centre.

6.3       This Warranty only applies where the Product is primarily and predominantly used for household and domestic purposes.  This Warranty does not support commercial uses.

6.4       In addition to other limitations and exclusions the Extended Warranty will not apply to consumable or high wear parts including without limitation:  grinder or sanding discs or sanding paper or pads and flanges;  chucks;  collets;  fixtec systems, chainsaw and pruner chains;  saw blades of any kind or other cutting or trimmer blades or wires/cords including line trimmer heads or bump knobs;  spark plugs;  drill bits or attachments such as screw diver fittings;  dust bags and vacuum bags or filters;  brushes;  bearings;  seals and o-rings;  allen keys.

  1. TO CLAIM THIS WARRANTY

7.1       You must provide proof of your purchase including the date and place of purchase.  You must retain the sales docket receipt as proof of purchase present proof of purchase with the Product to the point of sale, to Us or to Our authorised service centre.  We reserve the right to require You to provide the original sales receipt or a true and legible copy thereof as proof of purchase.

7.2       For Warranty claims or service in Australia please refer to the wizardtools.com.au website or contact the Australian Customer Support line by telephone to 1300 645 928 or email to info@wizardtools.com.au to obtain the nearest authorised service centre.

7.3       We may also require further information from You in order to process the Warranty claim, such as your contact details which can include the following:

(a)        phone number;

(b)        address and postal address (if different);  and,

(c)        email address

7.4       We will endeavour to promptly honour all Warranty claims that are submitted in accordance with these Warranty terms and conditions

8. ORDERS

8.1 You may place an Order by following the instructions on the Website. By placing an Order, you make offer to enter into an agreement to purchase the Product(s) the subject of Your Order (Purchase Contract).

8.2 Orders will be deemed to have been received by Wizard Tools at the time Wizard Tools sends an Order confirmation to Your nominated e-mail address.

8.3 Wizard Tools  is an online business and will primarily communicate with Customers via e-mail. It is the Customer’s responsibility to ensure the correct contact details are entered and that the nominated e-mail address is regularly checked for correspondence.

8.4 Wizard Tools reserves the right to decline to enter into a Purchase Contract with You and may cancel Your Order at any time prior to dispatch of the Product(s).

8.5 In the event of a cancelled Order not dispatched, funds paid in relation to that Order will be refunded in full. You will be provided with e-mail confirmation of the cancellation and refund.

8.6 Wizard Tools does not accept any responsibility for Orders that are declined, delayed or not accepted due to disruptions with internet connections.

8.7 Wizard Tools shall not be liable for any delay in performing any of its obligations under this Agreement if such delay is caused by circumstances beyond the reasonable control of Wizard Tools (or its affiliates), and Wizard Tools shall be entitled to a reasonable extension of time for the performance of such obligations.

8.8 Where You have provided an incorrect or incomplete delivery address for Your Order, We may charge a redelivery fee for each subsequent delivery attempt.

9. PAYMENT

9.1 You may provide Your nominated credit card during the purchase process described on the Website.

9.2 Payment for Orders will be processed immediately upon confirmation of Your Order.

9.3 If Your nominated payment method triggers Our fraud prevention protocols, We may contact You to confirm additional details, or rescind the transaction. In this case, until Your Order has passed Our fraud prevention protocols Your Order will not be fulfilled. If you do not provide the requested information within up to 7 days, Your Order will be cancelled and Your payment will be refunded back to the method in which you paid. These information requests are sent to help protect credit card holders from online fraud.

9.4 Despite Our best efforts, on occasion it may be possible that a small number of the Products in Our range may be incorrectly priced on the Website. If We have made a mistake and a Product’s correct price is higher than the price on the Website, We may either contact You before shipping to request whether You want to buy the Product at the correct price or cancel Your Order. If a Product’s correct price is lower than the stated price on the Website, We will charge the lower amount and send You the Product, or where the higher incorrect price has been charged, We will refund the price difference and send You the Product.

10. DELIVERY AND OWNERSHIP OF THE GOODS

10.1 We try to ensure that all Products are delivered in a prompt and timely manner. However, from time to time, it is possible that shipping and other factors outside of Our control may result in delays. Wizard Tools does not accept any liability for loss or damage suffered by anyone as a result of any such delays.

10.2 The date of dispatch listed on the Website is the estimated date of dispatch as is reasonably estimated by Wizard Tools. Where scheduled dispatch of a Product is delayed by more than one week, Customers will be notified by e-mail via the e- mail address nominated in their Order. Customers are permitted to cancel their Order and receive a refund or store credit at any time prior to dispatch of the Product(s). Our estimated handling time is days and 5 to 7 business days for shipping.

10.3 Wizard Tools will not deliver Products to PO Box addresses.

10.4 Where a Customer gives written authority for Products to be delivered without a signature, any and all included insurance cover will be voided.

10.5 The couriers or postal services nominated by Wizard Tools will deliver Products during local business hours (9am to 5pm, Monday to Friday).

10.6 Wizard Tools is not responsible for the delivery times of Products. Once Products have been dispatched, it is the Customers responsibility to liaise with the courier nominated by Wizard Tools (as notified to the Customer) in relation to date and time of delivery. Wizard Tools Ltd shall not be liable for any inaccuracy of information provided to Customers relating to the date and time of delivery.
